What you can deduct in a sex change

In a recent tax court case, Gender Identity Disorder is recognized as a disease. In the case, the taxpayer was entitled to deduct as medical expenses the costs of gender reassignment surgery as well as hormone therapy.  The Court concluded that the hormone therapy and gender reassignment surgery “treated” the disease of Gender Identity Disorder.

However, the court concluded that the taxpayer was not entitled to that part of the expenses related to her breast augmentation as it determined these expenses were cosmetic in nature and did not “meaningfully promote the proper functioning of her body within the meaning of IRS Code.  It therefore found the surgery not medically necessary.
